This just breaks my heart. I don't know all the particulars, will go to their website to see I can find out more.

Second Cocker is a great group. When I adopted Toby from them 3 yrs ago, he had a small behavioral problem and, at their own expense, after I brought him home with me, they provided me with a session with an animal trainer to help solve the problem.

It breaks my heart too, AND makes me really angry! I ran up against similarly arrogant, power-abusing shelter officials when I was doing rescue... it's just so sad because the animals are the ones that lose.

I read this earlier on Facebook, and have sent emails to all 4 people. Second Chance is a GREAT rescue, Elizabeth and company have been doing really good work for lots of years. I commend them for speaking out and naming names, that's the only way to get these things changed.

What I don't understand is why, if "Jan" worked with them previously she opted to PTS Einstein instead of allowing the rescue to assist him. What changed? Her actions make no sense and poor Einstein has paid the price.

Hayden's Law, in California, which says rescues Must be allowed to take the dogs, was passed in spite of huge objections from the shelter/animal control folks, because it essentially gave rescues the opportunity to deal with dogs that the shelters couldn't/wouldn't deal with, for any number of reasons. And it clearly put the burden of liability on the rescues.

But it is also seen as undermining the authority of the animal control officers. Some of them will look for any opportunity to wield their power. This really isn't a big departure from her usual MO for this animal control officer. This particular person has a long history of Not working with rescues, though she has very occasionally released a dog to Elizabeth.

In this particular case, apparently the dog had a bite history. Second Chance Cocker Rescue was looking to offer just that- a second chance to a dog to see if he could be safely rehomed- by having a trainer work with him, not just by looking at the notes from people who didn't want him any more.

My own personal experience in rescue involved dogs that were supposedly biters, who were actually huge lovers. And, conversely, dogs who had "no problems" who had been mistreated long enough to make them wild and vicious. I learned quickly not to pay much attention to what was reported about a dog, but to look carefully for myself. Ha, and I have the bite scars to remind me!

It's appalling that a shelter "professional" would PTS a dog as part of a power play. Is there recourse for the rescue? Can they file a complaint? In actuality Jan broke the law. Poor pup never got his second chance :cry
